Mackenzie Goldberg Johnson deals with all formal insolvency procedures - Bankruptcies, Individual and Company Voluntary Arrangements, Compulsory and Creditors’ Voluntary Liquidations and Administration Orders.
If you or your firm are a creditor in any insolvency proceedings, you are entitled to nominate an Insolvency Practitioner to act on your behalf, in both personal and corporate insolvencies.
We can act for you. We would deal with all the paperwork to lodge your claim, including filing an appropriate Proof of Debt and Proxy form; we would liaise with the Official Receiver’s offices, other creditors and other Insolvency Practitioners’ firms, at no cost to yourself. We would also ensure you are personally represented as necessary at any Meetings of Creditors, nationwide, and provide you with feedback in all cases.
Where an insolvency order has not yet been made, we can advise as to the best course of action, inform you as to the likely return you may receive by instigating insolvency proceedings and we could represent you from an early stage.
We utilise advanced databases and computerised business tools which enable us to promptly track down assets in order to provide you with early assessments in all cases and advise you of the potential for dividends to be paid.
As part of our professional duties we will investigate the insolvent’s affairs in all cases where we are appointed trustee, or liquidator, and seek to identify and recover any undisclosed assets. We can also challenge and remedy the adverse effects of preferences, transactions at undervalue, excessive remunerations, fraudulent or wrongful trading and voidable dispositions.
In all cases, we would act immediately, upon the making of the order, and when appointed trustee, or liquidator, we would look for the optimum realisation of assets to enable the maximum payment of dividends in the quickest possible time.
